제1조 목적

본 서비스 이용약관은 JIHYUK JUNG이 개인 운영자로 제공하는 SEND 앱, 웹사이트 및 관련 서비스의 이용 조건, 운영자와 이용자의 권리·의무, 책임사항 및 기타 필요한 사항을 정하는 것을 목적으로 합니다.

제2조 정의

1. “SEND” 또는 “서비스”란 운영자가 제공하는 SEND 모바일 앱, 웹사이트 및 이에 부수되는 모든 기능과 서비스를 의미합니다.
2. “운영자”란 SEND를 운영하는 개인 운영자 JIHYUK JUNG을 의미합니다.
3. “이용자”란 본 약관에 따라 SEND를 이용하는 모든 개인을 의미합니다.
4. “계정”이란 이용자가 SEND의 일부 기능을 이용하기 위해 생성하거나 인증하는 식별 단위를 의미합니다.
5. “콘텐츠”란 SEND 내에서 제공되는 텍스트, 이미지, 데이터, 기능, 화면, 소프트웨어, 디자인 및 기타 자료를 의미합니다.

제3조 약관의 동의 및 적용

1. 이용자는 SEND를 설치, 접속, 가입 또는 이용함으로써 본 약관에 동의한 것으로 봅니다.
2. 본 약관에 동의하지 않는 경우 SEND를 이용해서는 안 됩니다.
3. 운영자는 필요한 경우 본 약관을 변경할 수 있으며, 변경된 약관은 앱, 웹사이트 또는 기타 적절한 방법으로 공지합니다.
4. 변경된 약관은 공지된 시행일부터 적용됩니다. 이용자가 변경 약관 시행 후 서비스를 계속 이용하는 경우 변경 약관에 동의한 것으로 봅니다.
5. 다만, 이용자에게 중대한 영향을 미치는 변경의 경우 운영자는 합리적인 기간 전에 공지하거나 가능한 경우 이메일 등으로 안내합니다.

제4조 서비스의 제공

1. SEND는 이용자에게 무료로 제공됩니다.
2. 운영자는 App Store, Google Play 및 웹을 통해 서비스를 제공할 수 있습니다.
3. 운영자는 서비스의 기능, 화면, 제공 방식, 지원 언어, 운영 정책을 변경하거나 개선할 수 있습니다.
4. 현재 SEND는 한국어, 영어, 일본어, 중국어, 힌디어, 포르투갈어, 인도네시아어, 스페인어, 튀르키예어, 독일어를 지원할 수 있습니다.
5. 서비스는 전세계 이용자를 대상으로 제공될 수 있으나, 일부 국가 또는 지역에서는 법령, 기술적 제한, 앱마켓 정책 또는 운영상 사유로 서비스 이용이 제한될 수 있습니다.

제5조 무료 서비스

1. SEND는 현재 유료 서비스, 유료 구독, 인앱 결제 기능을 제공하지 않습니다.
2. 향후 유료 서비스가 도입되는 경우 운영자는 별도의 결제 조건, 환불 정책, 구독 조건 등을 사전에 고지합니다.
3. 앱마켓을 통한 다운로드, 설치, 업데이트 및 이용에는 각 앱마켓의 약관과 정책이 적용될 수 있습니다.

제6조 회원가입 및 계정

1. SEND의 일부 기능은 계정 생성 또는 이메일 인증을 요구할 수 있습니다.
2. 이용자는 계정 생성 또는 인증 시 정확하고 최신의 정보를 제공해야 합니다.
3. 이용자는 본인의 계정 정보를 안전하게 관리할 책임이 있습니다.
4. 이용자는 자신의 계정을 제3자에게 양도, 대여, 공유하거나 부정하게 이용하게 해서는 안 됩니다.
5. 운영자는 계정 도용, 부정 이용, 보안 위협 또는 약관 위반이 의심되는 경우 해당 계정의 이용을 제한하거나 필요한 조치를 할 수 있습니다.

제7조 계정 탈퇴 및 삭제

1. 이용자는 언제든지 계정 삭제 또는 서비스 탈퇴를 요청할 수 있습니다.
2. 계정 삭제 요청은 앱 또는 웹에서 제공되는 삭제 기능이 있는 경우 해당 기능을 통해 진행할 수 있으며, 별도 기능이 없는 경우 contact@sendquiz.net 으로 요청할 수 있습니다.
3. 운영자는 계정 삭제 요청의 정당한 처리를 위해 이메일 인증 등 본인 확인 절차를 요구할 수 있습니다.
4. 계정 삭제가 완료되면 관련 개인정보는 개인정보처리방침에 따라 삭제됩니다.
5. 다만, 법령 준수, 보안, 부정 이용 방지, 분쟁 대응 등 정당한 사유가 있는 경우 필요한 범위에서 일부 정보가 일정 기간 보관될 수 있습니다.
6. 백업 데이터에 포함된 정보는 계정 삭제 후 30일 이내 순차적으로 삭제됩니다.

제8조 미성년자의 이용

1. SEND는 전체 연령 이용이 가능한 서비스로 운영될 수 있습니다.
2. 미성년자는 거주 국가 또는 지역의 법령상 필요한 경우 부모 또는 법정대리인의 동의를 받아 서비스를 이용해야 합니다.
3. 만 14세 미만의 한국 이용자, 만 13세 미만의 미국 이용자 또는 해당 국가 법령상 보호가 필요한 아동이 개인정보 제공이 필요한 기능을 이용하는 경우, 운영자는 관련 법령에 따라 법정대리인 동의 또는 적절한 보호 조치를 요구할 수 있습니다.
4. 법정대리인은 미성년자의 서비스 이용을 관리·감독할 책임이 있습니다.
5. 운영자는 아동 또는 미성년자의 개인정보 보호를 위해 일부 기능, 광고, 맞춤형 광고 또는 데이터 처리를 제한할 수 있습니다.

제9조 광고 및 분석 도구

1. SEND는 무료 서비스 제공을 위해 Google AdMob 등 광고 서비스를 사용할 수 있습니다.
2. 이용자의 동의가 있는 경우 맞춤형 광고가 제공될 수 있으며, 동의하지 않거나 관련 법령상 허용되지 않는 경우 비맞춤형 광고가 제공되거나 광고 제공이 제한될 수 있습니다.
3. SEND는 서비스 품질 개선, 오류 분석, 이용 통계 확인을 위해 Firebase Analytics 등 분석 도구를 사용할 수 있습니다.
4. 광고 및 분석 도구의 사용과 관련한 자세한 사항은 개인정보처리방침에서 정합니다.

제10조 마케팅 및 알림

1. 운영자는 이용자의 동의가 있는 경우 서비스 관련 안내, 업데이트, 이벤트, 마케팅성 정보 또는 알림을 발송할 수 있습니다.
2. 이용자는 언제든지 마케팅 수신 또는 알림 수신에 대한 동의를 철회할 수 있습니다.
3. 서비스 운영, 보안, 약관 변경, 개인정보처리방침 변경, 계정 관련 안내 등 필수 고지는 수신 동의 여부와 관계없이 발송될 수 있습니다.

제11조 이용자의 의무

이용자는 SEND 이용과 관련하여 다음 행위를 해서는 안 됩니다.

1. 관련 법령 또는 본 약관을 위반하는 행위
2. 타인의 개인정보, 계정 또는 인증 정보를 도용하는 행위
3. 허위 정보를 제공하는 행위
4. 서비스의 정상 운영을 방해하는 행위
5. 서버, 네트워크, 데이터베이스 또는 보안 시스템에 무단 접근하는 행위
6. 악성 코드, 자동화 프로그램, 봇, 스크래퍼 등을 이용하여 서비스를 부정 이용하는 행위
7. SEND의 소스코드, 구조, 알고리즘, 데이터 또는 콘텐츠를 무단 복제, 수정, 배포, 역설계하는 행위
8. 광고, 분석, 보안 또는 이용 제한 기능을 우회하거나 조작하는 행위
9. 타인의 권리, 명예, 사생활, 지식재산권을 침해하는 행위
10. 불법, 유해, 사기, 스팸 또는 부정한 목적으로 서비스를 이용하는 행위
11. 기타 운영자가 합리적으로 부적절하다고 판단하는 행위

제12조 서비스 이용 제한

1. 운영자는 이용자가 본 약관을 위반하거나 서비스 운영, 보안, 다른 이용자의 권리 보호를 위해 필요하다고 판단되는 경우 서비스 이용을 제한할 수 있습니다.
2. 이용 제한에는 경고, 일시 정지, 기능 제한, 계정 삭제, 접근 차단 등이 포함될 수 있습니다.
3. 운영자는 긴급한 보안 문제, 법령 위반, 제3자의 권리 침해 또는 명백한 부정 이용이 있는 경우 사전 통지 없이 필요한 조치를 할 수 있습니다.

제13조 지식재산권

1. SEND 및 SEND에 포함된 소프트웨어, 화면, 디자인, 로고, 명칭, 텍스트, 데이터, 기능 및 기타 콘텐츠에 관한 권리는 운영자 또는 정당한 권리자에게 귀속됩니다.
2. 이용자는 서비스를 개인적이고 비상업적인 목적으로 이용할 수 있는 제한적 권리만 부여받습니다.
3. 이용자는 운영자의 사전 서면 동의 없이 SEND 또는 그 일부를 복제, 수정, 배포, 판매, 대여, 공개, 전송, 역설계하거나 상업적으로 이용할 수 없습니다.
4. 이용자가 운영자에게 제공하는 의견, 제안, 피드백은 서비스 개선을 위해 활용될 수 있으며, 별도의 보상은 제공되지 않습니다.

제14조 커뮤니티 기능

1. 현재 SEND는 별도의 커뮤니티, 게시판, 댓글, 공개 게시물 기능을 제공하지 않습니다.
2. 향후 이용자 게시물 또는 커뮤니티 기능이 추가되는 경우 운영자는 별도의 게시물 운영 정책 또는 추가 약관을 마련할 수 있습니다.

제15조 제3자 서비스

1. SEND는 서비스 제공을 위해 Oracle Cloud, Amazon Web Services, AWS SES, Google AdMob, Firebase Analytics, App Store, Google Play 등 제3자 서비스를 사용할 수 있습니다.
2. 제3자 서비스의 이용에는 해당 제3자의 약관과 개인정보 처리방침이 적용될 수 있습니다.
3. 운영자는 제3자 서비스의 장애, 정책 변경, 보안 사고 또는 이용 제한으로 인해 SEND의 일부 기능이 제한될 수 있음을 이용자에게 안내할 수 있습니다.

제16조 서비스 변경, 중단 및 종료

1. 운영자는 서비스 개선, 유지보수, 보안, 기술상 필요, 정책 변경 또는 운영상 사유로 서비스의 전부 또는 일부를 변경, 중단 또는 종료할 수 있습니다.
2. 운영자는 가능한 경우 서비스 변경, 중단 또는 종료에 대해 사전에 공지합니다.
3. 다만, 긴급 보안 문제, 시스템 장애, 천재지변, 제3자 서비스 장애, 법령상 필요 등 불가피한 경우 사전 공지 없이 서비스를 중단할 수 있습니다.

제17조 보증의 부인

1. SEND는 현재 상태 그대로 제공됩니다.
2. 운영자는 서비스가 항상 중단 없이, 오류 없이, 안전하게 또는 특정 목적에 적합하게 제공된다고 보증하지 않습니다.
3. 운영자는 이용자의 기기 환경, 네트워크 상태, 앱마켓 정책, 제3자 서비스 상태 등에 따라 서비스 이용이 제한될 수 있음을 보증하지 않습니다.
4. 본 조항은 관련 법령상 배제할 수 없는 소비자 권리 또는 운영자의 고의·중대한 과실 책임을 제한하지 않습니다.

제18조 책임 제한

1. 운영자는 관련 법령상 허용되는 범위 내에서 서비스 이용 또는 이용 불가로 인해 발생한 간접 손해, 특별 손해, 결과적 손해, 데이터 손실, 기대 이익 상실 등에 대해 책임을 지지 않습니다.
2. 운영자는 이용자의 귀책사유, 약관 위반, 부정 이용, 제3자 서비스 장애, 불가항력으로 인한 손해에 대해 책임을 지지 않습니다.
3. 운영자의 책임이 인정되는 경우에도, 관련 법령상 허용되는 범위 내에서 운영자의 책임은 직접적이고 통상적인 손해로 제한됩니다.
4. 본 조항은 운영자의 고의 또는 중대한 과실로 인한 책임, 생명·신체에 대한 손해, 관련 법령상 제한할 수 없는 책임에는 적용되지 않습니다.

제19조 개인정보 보호

1. 운영자는 서비스 제공 과정에서 개인정보를 처리할 수 있습니다.
2. 개인정보의 수집, 이용, 보관, 삭제, 제3자 제공, 처리위탁, 국외 이전, 이용자 권리 등에 관한 사항은 SEND 개인정보처리방침에 따릅니다.

제20조 고객지원

1. SEND의 고객지원은 이메일로만 제공됩니다.
2. 고객센터 이메일은 contact@sendquiz.net 입니다.
3. 전화 상담은 제공하지 않습니다.
4. 운영자는 문의 내용, 서비스 운영 상황, 기술적 사정에 따라 답변에 시간이 소요될 수 있습니다.

제21조 준거법 및 관할

1. 본 약관은 특정 국가의 법이나 전속 관할법원을 별도로 지정하지 않습니다.
2. 서비스 이용과 관련한 분쟁은 이용자에게 적용되는 강행 법령 및 관할 규칙에 따라 해결됩니다.
3. 운영자와 이용자는 분쟁 발생 시 우선 성실한 협의를 통해 해결하기 위해 노력합니다.

제22조 언어

1. 본 약관은 한국어와 영어 등 여러 언어로 제공될 수 있습니다.
2. 한국어본은 원문으로 작성되며, 번역본과 의미가 충돌하는 경우 관련 법령상 달리 요구되지 않는 한 한국어본이 우선합니다.
3. 이용자의 거주 국가 또는 지역에서 적용되는 강행 법령상 이용자에게 더 유리한 권리가 인정되는 경우 해당 법령이 우선 적용됩니다.

1. Purpose

These Terms of Service govern your access to and use of SEND, including the SEND mobile application, website, and related services operated by JIHYUK JUNG as an individual operator.

2. Definitions

1. “SEND” or the “Service” means the SEND mobile app, website, and all related features and services.
2. “Operator,” “we,” “us,” or “our” means JIHYUK JUNG, the individual operator of SEND.
3. “User,” “you,” or “your” means any person who accesses or uses SEND.
4. “Account” means a user identity or authentication unit used to access certain features of SEND.
5. “Content” means text, images, data, features, screens, software, designs, and other materials provided through SEND.

3. Acceptance of Terms

1. By installing, accessing, creating an account for, or using SEND, you agree to these Terms.
2. If you do not agree to these Terms, you must not use SEND.
3. We may update these Terms from time to time.
4. Updated Terms will apply from the effective date stated in the notice.
5. If you continue to use SEND after the updated Terms become effective, you will be deemed to have accepted the updated Terms.
6. If a change materially affects your rights or obligations, we will provide reasonable prior notice through the app, website, email, or another appropriate method where practicable.

4. Provision of the Service

1. SEND is provided free of charge.
2. SEND may be provided through the App Store, Google Play, and the web.
3. We may modify, improve, suspend, or discontinue any feature, screen, supported language, or operating policy of the Service.
4. SEND may support Korean, English, Japanese, Chinese, Hindi, Portuguese, Indonesian, Spanish, Turkish, and German.
5. SEND may be offered globally, but access may be limited in certain countries or regions due to legal, technical, app store, or operational reasons.

5. Free Service

1. SEND currently does not provide paid services, paid subscriptions, or in-app purchases.
2. If we introduce paid features in the future, we will provide separate payment terms, refund policies, and subscription terms in advance.
3. Downloads, installations, updates, and use through app stores may also be subject to the terms and policies of the relevant app store.

6. Accounts

1. Certain features of SEND may require account creation or email verification.
2. You must provide accurate and up-to-date information when creating or verifying an account.
3. You are responsible for maintaining the confidentiality and security of your account information.
4. You must not transfer, lend, share, or misuse your account.
5. We may restrict or take action against an account if we reasonably suspect account theft, unauthorized use, a security threat, or a violation of these Terms.

7. Account Deletion

1. You may request deletion of your account at any time.
2. If an account deletion feature is available in the app or on the web, you may use that feature. Otherwise, you may request deletion by contacting contact@sendquiz.net.
3. We may require email verification or another appropriate verification step to confirm the legitimacy of the deletion request.
4. Once account deletion is completed, related personal data will be deleted in accordance with the SEND Privacy Policy.
5. However, we may retain certain information for a limited period where necessary for legal compliance, security, fraud prevention, dispute resolution, or other legitimate reasons.
6. Data contained in backups will be deleted in stages within 30 days after account deletion.

8. Minors

1. SEND may be operated as a service available to all ages.
2. Minors must use SEND with the consent of a parent or legal guardian where required by the laws of their country or region.
3. If a Korean user under 14, a U.S. user under 13, or a child protected under applicable local law uses features that require personal data, we may require parental or guardian consent or apply appropriate protective measures.
4. Parents and legal guardians are responsible for supervising minors’ use of SEND.
5. We may restrict certain features, advertising, personalized advertising, or data processing to protect children and minors.

9. Advertising and Analytics

1. SEND may use advertising services such as Google AdMob to support the free Service.
2. Personalized advertising may be provided if you consent. If you do not consent or if applicable law does not permit it, non-personalized advertising may be shown or advertising may be limited.
3. SEND may use analytics tools such as Firebase Analytics to improve service quality, analyze errors, and understand usage statistics.
4. Details regarding advertising and analytics are provided in the SEND Privacy Policy.

10. Marketing and Notifications

1. If you consent, we may send service-related notices, updates, events, marketing communications, or notifications.
2. You may withdraw your consent to marketing or notifications at any time.
3. Essential notices, such as those related to service operation, security, changes to these Terms, changes to the Privacy Policy, or account matters, may be sent regardless of your marketing consent status.

11. User Obligations

You must not do any of the following:

1. Violate applicable laws or these Terms.
2. Misuse another person’s personal data, account, or authentication information.
3. Provide false information.
4. Interfere with the normal operation of the Service.
5. Access servers, networks, databases, or security systems without authorization.
6. Use malware, automated programs, bots, scrapers, or similar tools to misuse the Service.
7. Copy, modify, distribute, reverse engineer, or otherwise misuse SEND’s source code, structure, algorithms, data, or content.
8. Circumvent or manipulate advertising, analytics, security, or access-control features.
9. Infringe another person’s rights, reputation, privacy, or intellectual property rights.
10. Use the Service for illegal, harmful, fraudulent, spam, or abusive purposes.
11. Engage in any other conduct that we reasonably consider inappropriate.

12. Restrictions and Suspension

1. We may restrict your use of the Service if you violate these Terms or if we consider it necessary to protect service operations, security, or the rights of other users.
2. Restrictions may include warnings, temporary suspension, feature limitations, account deletion, or access blocking.
3. In urgent cases involving security risks, legal violations, third-party rights violations, or clear misuse, we may take necessary action without prior notice.

13. Intellectual Property

1. Rights in SEND and its software, screens, designs, logos, names, text, data, features, and other content belong to the Operator or the relevant rights holders.
2. You receive only a limited right to use the Service for personal and non-commercial purposes.
3. You must not copy, modify, distribute, sell, rent, disclose, transmit, reverse engineer, or commercially exploit SEND or any part of it without our prior written consent.
4. Feedback, suggestions, or comments you provide may be used to improve the Service without compensation.

14. Community Features

1. SEND currently does not provide community, bulletin board, comment, or public posting features.
2. If user-generated content or community features are introduced in the future, we may provide separate content policies or additional terms.

15. Third-Party Services

1. SEND may use third-party services such as Oracle Cloud, Amazon Web Services, AWS SES, Google AdMob, Firebase Analytics, the App Store, and Google Play.
2. Your use of third-party services may be subject to the terms and privacy policies of those third parties.
3. Certain SEND features may be affected by outages, policy changes, security incidents, or access restrictions involving third-party services.

16. Service Changes, Suspension, and Termination

1. We may modify, suspend, or terminate all or part of the Service for improvement, maintenance, security, technical, policy, or operational reasons.
2. Where practicable, we will provide prior notice of significant service changes, suspension, or termination.
3. However, we may suspend or restrict the Service without prior notice in cases of urgent security issues, system failures, force majeure events, third-party service failures, or legal requirements.

17. Disclaimer

1. SEND is provided on an “as is” and “as available” basis.
2. We do not warrant that the Service will always be uninterrupted, error-free, secure, or suitable for a particular purpose.
3. We do not warrant that the Service will be available in all device environments, network conditions, app store situations, or third-party service conditions.
4. Nothing in this section limits any consumer rights that cannot be excluded under applicable law or any liability arising from our intentional misconduct or gross negligence.

18. Limitation of Liability

1. To the maximum extent permitted by applicable law, we are not liable for indirect, special, consequential, incidental, or punitive damages, loss of data, or loss of expected profits arising from your use of or inability to use the Service.
2. We are not liable for damages caused by your fault, violation of these Terms, misuse, third-party service failures, or force majeure events.
3. Where our liability is recognized, it will be limited to direct and ordinary damages to the extent permitted by applicable law.
4. This section does not apply to liability for intentional misconduct, gross negligence, death or personal injury, or any liability that cannot be limited under applicable law.

19. Privacy

1. We may process personal data in connection with providing SEND.
2. Details regarding collection, use, retention, deletion, sharing, processing, international transfers, and user rights are described in the SEND Privacy Policy.

20. Customer Support

1. Customer support for SEND is provided by email only.
2. The support email address is contact@sendquiz.net.
3. Phone support is not provided.
4. Response times may vary depending on the nature of the inquiry, service conditions, and technical circumstances.

21. Governing Law and Jurisdiction

1. These Terms do not designate a specific governing law or exclusive court jurisdiction.
2. Any dispute relating to the Service will be resolved in accordance with applicable mandatory laws and jurisdictional rules.
3. The Operator and the user will first try to resolve disputes through good-faith discussions.

22. Language

1. These Terms may be provided in Korean, English, and other languages.
2. The Korean version is the original version. If there is a conflict between the Korean version and a translated version, the Korean version will prevail unless applicable law requires otherwise.
3. If mandatory laws in your country or region provide you with stronger rights, those mandatory laws will prevail.
